NCDAA Legislative Updates

The Nebraska Legislature convened on January 6, 2010. Bill introduction concluded on January 21, 2010. The Legislative Committee of NCDAA and Board of Directors met to take positions on the bills that were introduced.

NCDAA opposes the following bills:

LB 771 which amends assault by a confined person to include a mentally ill dangerous person or dangerous sex offender and adds to places of confinement to include a jail, an adult correctional or penal institution, a youth rehabilitation and treatment center or a treatment facility. Employees of the Department of Health and Human Services who work in a youth rehabilitation center are added to the list of what constitutes assault in the first degree.

LB 840 which changes provisions relating to criminal attempt.

LB 843 which changes the arson statute to include property contained in the building.

LB 859 which repeals the statute providing jury trials for which the maximum sentence is less than six months imprisonment and which arise under a city ordinance.

LB 894 which changes provisions relating to shoplifting by adding a provision that makes it a crime to alter or disable a security device countermeasure.

LB 984 which increases a penalty related to child abuse.

LB 1046 which changes provisions relating to speedy trial.

NCDAA supports the following bills:

LB 915 which provides for driver’s license and state ID cards to be used in compiling jury lists.

LB 923 which changes provisions relating to the sealing of juvenile criminal justice records.

LB 988 which changes provisions relating to credit for imprisonment for fines and costs.

LB 990 which changes the reduction of sentence provisions for a person sentenced to a city or county jail.

 

All other bills on the list will be monitored. The legislature is currently setting these bills for hearing over the next few weeks.
