The truth and nothing but the truth:

How to properly allege and collaterally attack a search warrant using Franks v. Delaware

with Tim Noerrlinger

Friday June 19th, 2020

This hour-long webinar will give an overview of Franks v. Delaware and its interpretation by Nebraska and the Federal Courts.  Specific cases and motions will be discussed to aid practitioners in understanding how to properly raise a collateral attack under Franks, along with the potential pitfalls to a Franks challenge.  You will learn how to make a substantial preliminary showing to the trial court as required by Franks. You will also learn how to properly conduct a Franks hearing if the court authorizes one after you have made the requisite showing. Having served as a prosecutor, Tim has unique experience valuable to criminal defense attorneys.

BIO: Tim Noerrling graduated from Nebraska Wesleyan University in 2002 with a B.A. in History and from the University of Nebraska College of Law in 2005.  He served as the Deputy Jefferson County Attorney from September of 2005 to September of 2007, and as the Deputy Otoe County Attorney in September of 2007 until May of 2013.  Since then he has been doing defense work at Naylor and Rappl.  He prosecuted a number of murder and other serious cases as a Deputy County Attorney.  His primary practice is handling defense cases and other ancillary matters including the administrative consequences of criminal violations and pardons.
